Military Retirement & Thrift Savings Plan Division

We explain your rights concerning military pensions, Thrift Savings Plan accounts, and the Uniformed Services Former Spouses’ Protection Act. This federal law allows state courts to treat military retired pay as marital or community property, but it doesn’t require a particular division formula. California generally applies a time rule comparing the years of marriage that overlapped creditable service with the total years of creditable service at retirement.

The 10/10 Rule governs payment administration, not whether a former spouse is entitled to part of the retired pay. Direct payment through the Defense Finance and Accounting Service generally requires at least 10 years of marriage overlapping 10 years of creditable military service. A California community property claim may still exist when that requirement isn’t met, although any awarded share would need to be paid another way.

Other retirement details may affect the division:

  • Frozen Benefit Rule: For divorces finalized after December 23, 2016, the divisible benefit is generally calculated using the service member’s rank and years of service when the divorce order is entered.
  • Military Pension Division Order: The Defense Finance and Accounting Service requires a qualifying order before processing a division of military retired pay.
  • Thrift Savings Plan: Contributions made during the marriage may require separate evaluation and appropriate language in the divorce orders.
